Amway UK - BERR appeals

The Department for Business Enterpise and Regulatory Reform (BERR) has submitted an appeal in the case of BERR vs Amway UK. BERR had accused Amway of "dream selling", being "inherently objectionable", an "unlawful lottery", and an "unlawful trading scheme". Mr Justice Norris had earlier dismissed all charges against Amway.
According to Amway, the basis of the Government's appeal is that the Judge was wrong in exercising his discretion not to wind up the Company given his findings about Amway's past conduct, and that he should not have accepted undertakings from Amway. BERR also alleges that there were procedural irregularities in the way the judge conducted the case.
Justice Norris refused an application by BERR to restrict Amway from resuming sponsorship activity whilst any appeal is pending and Amway has announced that sponsoring will resume on July 21, 2008.
